Right to know
and Freedom of expression
(Handbook for human right activists and citizens)
This is the first ever published
a handbook in Mongolia on these particular citizens
political right. It was compiled to inform human
rights activists and citizens of their rights and
encourages them to exercise their rights efficiently.
The structure of the handbook contains from 5 sections.
The first section
“What is the freedom of expression” briefly explains
that this particular right consists from group of
rights, right to believe, right to hold opinions,
right to thought and expression and specially considered
on the meanings of the principle “Free” expression.
It introduces how this right guaranteed in international
and local laws and about permissible limitation of
this right. Article 16.3 of the Constitution of Mongolia
guaranteed the citizens rights on freedom of thought,
opinion and expression, speech, press and peaceful
assembly. The section also explains about the importance
of these rights to the citizens. Freedom of expression
enables citizens to participate effectively in democracy;
it is an integral aspect of each citizen’s right to
self-development and fulfillment. It also explains
the importance of freedom expression in democratic
society.
The second section “How to express opinions and ideas”
introduces which types of expression are guaranteed
in the international and local laws. For instance,
free speech, publish, artistic expression, to seek,
receive and disseminate information, peaceful demonstration,
assembly, to submit application or complaint to Government
organization, strike, hunger-strike and other means
of his choice are guaranteed in laws and explained
some of these types of expression. It provides knowledge
on media freedom and its importance in democracy.
Because, the mass media that make the exercise of
freedom of expression a reality. But, right to freedom
of expression is not absolute. Both international
and national laws recognize that freedom of expression
may be restricted. The exercise of this right carries
with the special duties and responsibilities including
to protect dignity and reputation of others. The handbook
provided some knowledge on legal provisions concern
to reputation that protected in civil and criminal
laws of Mongolia.
In the third section
gives useful and necessary advice to citizens, where
they can apply if their rights violated by someone.
